Violation Proof

For NYC landlords · Facades (Local Law 11)

Your facade report, in your window.

A building over six stories files a facade report once a cycle, in a two-year window its tax block sets. SWARMP conditions are repaired by the report’s date; Unsafe ones need protection at once and repairs within 90 days. The window, the report and every repair sit on the building’s file.

What the law asks

One report a cycle, every condition followed.

Buildings over six stories, counting any wall or part of a wall above six stories, whatever the certificate of occupancy says. Six stories plus a cellar more than half above ground at any wall is covered too. DOB’s FISP list is a guide; identifying the building is the owner’s responsibility.

  1. 01The critical examinationBy a qualified exterior wall inspector (QEWI): every exterior wall and appurtenance, close up from a scaffold at least every 60 feet along each street-facing side. Drones and photos do not replace it.
  2. 02The technical report, in your windowFiled in DOB NOW within 60 days of the examination, $425, with a copy to the owner. A rejected report is refiled within 45 days.
  3. 03SWARMP: repairs by the report’s dateSafe today, but needing repair within one to five years. Repaired by the date the report set; a SWARMP condition still there next cycle is filed Unsafe, with a $2,000 penalty.
  4. 04Unsafe: protection now, repairs in 90 daysA sidewalk shed, fence or netting at once; repairs within 90 days of filing, or an extension (FISP1, up to 90 days, $305); the amended report within 2 weeks of the repair.
  5. 05The conditions certificateDOB issues it. Post it in a frame with a clear cover in the lobby or vestibule within 30 days.
  6. 06Your own recordsNo period is set for the owner. Keep this cycle’s report and the last at least: the next inspector compares with them, and a SWARMP condition carries over.

Which window is mine?

The last digit of the tax block number decides: 4, 5, 6 or 9 is A, Feb 21, 2025 to Feb 21, 2027; 0, 7 or 8 is B, Feb 21, 2026 to Feb 21, 2028; 1, 2 or 3 is C, Feb 21, 2027 to Feb 21, 2029. DOB’s FISP list shows the sub-cycle it has for your building.

My building has exactly six stories. Is it covered?

Only if a wall or part of a wall rises above six stories, or the cellar is more than half above ground at any exterior wall. ViolationProof leaves the law off for six stories until you switch it on.

When is Cycle 11?

Not set yet. Local Law 49 of 2025, in effect since October 1, 2026, lets DOB set intervals of 6 to 12 years by rule, and DOB has not published the new dates.

Does ViolationProof file with DOB?

No. Your QEWI files the report in DOB NOW. ViolationProof works out your window from the tax block, follows SWARMP and Unsafe conditions to the repair and the amended report, and keeps the reports on the building’s file.
