Violation Proof

For NYC landlords · Boilers

Every boiler, inspected and filed, every year.

Each boiler is inspected once a year, January 1 to December 31, and the report goes into DOB NOW within 14 days. Defects are corrected within 90 days and affirmed by day 104. The cycle, the reports and the corrections sit on the building’s file, with each deadline counted for you.

Why the records matter

A calendar year, three clocks.

The inspection belongs to the year. The report, the corrections and the affirmation each run from a date of their own.

Dec 31

The cycle runs January 1 to December 31: one inspection a year for a low-pressure boiler, an internal and an external one for a high-pressure boiler.

NYC Admin Code §28-303.2; 1 RCNY §103-01, §103-05
14 days

From the inspection to its report in DOB NOW, $30 per boiler. A late report is taken until January 14 of the next year at $50 a month, up to $600; after that it has expired: $1,000 and a new inspection.

NYC Admin Code §28-303.7; 1 RCNY §103-01(c), (e), (f)
90 days

To correct the defects the inspection found, then 14 days to file the affirmation of correction, and never more than 104 days after the inspection.

NYC Admin Code §28-303.7.1; DOB, Boiler compliance

What the law asks

An inspection a year, a report in 14 days.

Every boiler in a residential building of six units or more, and in any commercial or mixed-use building. Low-pressure boilers in residential buildings of five units or fewer are exempt, and so is a boiler inside one apartment that heats only that apartment.

  2. 02High pressure: internal and externalAn insurance company’s inspector does both, about six months apart, and tells DOB 10 days before the internal one. Tenants get 48 hours’ notice of the shutdown, at each unit and in the lobby.

Which boilers need the yearly inspection?

Every boiler in a residential building of six units or more, and in any commercial or mixed-use building. Exempt: low-pressure boilers in residential buildings of five units or fewer, and a boiler inside one apartment that serves only that apartment.

What does a missed inspection cost?

A report not filed by January 14 of the next year has expired: the failure-to-file penalty is $1,000 per boiler, and the violation stays on the property until it is paid and a current report is filed. Open boiler violations hold up a final certificate of occupancy.

Is it 45 days to file, or 14?

14. Local Law 126 of 2021 changed the deadlines from January 1, 2022: 14 days to file the report, 90 days to correct defects. Some DOB pages still show the old 45 and 180 days.

Does ViolationProof file with DOB?

No. Your inspector files the report in DOB NOW. ViolationProof counts the cycle, the 14 days, the 90 days and the 104-day stop, and keeps the reports and tracking numbers on the building’s file.
