Benchmark by May 1, post the grade by October 31.
A building over 25,000 square feet benchmarks last year’s energy by May 1, posts its energy grade every October, and files its LL97 emissions report on the pathway DOB gives it. The dates, the confirmations and the labels sit on the building’s file, with each deadline counted for you.

Why the records matter
Three laws, one building file.
Benchmarking feeds the grade and the LL97 report: miss May 1, and October’s label is an F.
Last year’s energy and water use in ENERGY STAR Portfolio Manager, shared with the City, every year. $500 if late, and $500 more each quarter until it is in.
NYC Admin Code §28-309.4; 1 RCNY §103-06(l)(1)DOB’s energy grade label, issued October 1, posted near each public entrance within 30 days. $1,250 if not.
NYC Admin Code §28-309.12.3; 1 RCNY §103-06(l)(2)Per metric ton of CO2e over the building’s LL97 limit, each year; and $0.50 per square foot a month for a report not filed.
NYC Admin Code §28-320.6, §28-320.6.2What the law asks
A report each May, a label each October.
Buildings over 25,000 gross square feet in DOF’s records; two or more buildings on a lot together over 100,000 (LL84) or 50,000 (LL97); condo buildings under one board the same. Tax class 1 homes are outside LL84; buildings more than 35% rent regulated report once under Article 321 instead of every year.

- 02The energy grade labelA from 85, B 70–84, C 55–69, D below 55, F for not benchmarking, N where no score is possible. Posted 4 to 6 feet up near each public entrance by October 31, and kept up for the year. Grade N posts nothing.
- 03LL97: your pathwayDOB’s Covered Buildings List gives each building a pathway: CP0 reports every May 1 since 2025, CP1 from 2027, CP2 from 2036, CP3 once under Article 321, CP4 not at all.
- 04The LL97 reportCertified by a registered design professional, filed in BEAM after the $210 fee in DOB NOW. A compliant report filed by June 30 carries no penalty; an extension to August 29 is asked for by June 30, $60.

Is my building covered?
If it is over 25,000 gross square feet in DOF’s records, or shares a lot with buildings that together pass the threshold. DOB’s Covered Buildings List, published each year, names every covered building by BBL and BIN with its LL97 pathway, and DOF tells owners on the November tax bill.
What is my LL97 pathway?
Column D of DOB’s Covered Buildings List, CP0 to CP4. A building with some rent-regulated units, 35% or fewer, is CP1 and reports from 2027; more than 35% is CP3, one Article 321 report.
Was there an extension in 2026?
Not for benchmarking: DOB’s 2025 extensions did not carry into 2026. For LL97, owners had until June 30, 2026 to ask for an extension to August 29.
Does ViolationProof file for me?
No. You or your consultant share the benchmarking and file the LL97 report. ViolationProof counts each deadline by your pathway, and keeps the confirmations, the labels and the reports on the building’s file.
